1. Acceptance of Terms

By subscribing to or using AnswerFly ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our service.

2. Description of Service

AnswerFly provides an AI-powered voice receptionist service for plumbing businesses. The service includes 24/7 call answering, lead capture, SMS notifications, call recording, transcription, and access to a performance dashboard. Service tiers (Basic, Pro, Elite) differ in monthly minutes included and features available.

3. Billing and Payment

AnswerFly charges a one-time setup fee upon signup and a recurring monthly subscription fee. All plans are month-to-month with no long-term contracts. Monthly fees are billed in advance. Overage minutes are billed at the per-minute rate for your plan at the end of each billing period. All fees are non-refundable except as required by law.

4. Cancellation Policy

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the service until the end of the paid period. We do not provide pro-rated refunds for mid-cycle cancellations.

5. Acceptable Use

You agree to use AnswerFly only for lawful business purposes. You may not use the service to deceive callers in ways that cause harm, collect information illegally, violate any applicable laws or regulations, or infringe on the rights of third parties.

6. Call Recording Compliance

You are responsible for ensuring that your use of AnswerFly's call recording features complies with all applicable federal, state, and local laws regarding call recording and consent. Some states require all-party consent for call recording. You agree to comply with all applicable recording laws and to indemnify AnswerFly for any claims arising from your failure to do so.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for damages resulting from service interruptions.

8. Limitation of Liability

AnswerFly's liability to you for any cause whatsoever shall be limited to the amount you paid for the service in the 3 months preceding the claim. We are not liable for lost profits, missed business opportunities, or indirect damages of any kind.

9. Intellectual Property

You retain ownership of your business data, call recordings, and lead information. AnswerFly retains ownership of the platform, AI models, and all software underlying the service. You grant AnswerFly a limited license to use your business information solely to provide and improve the service.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days notice for material changes. Continued use of the service after the effective date of changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Hillsborough County, Florida.

12. SMS Terms & Conditions

By providing your mobile number and checking the consent box on our website, you agree to receive automated text messages from AnswerFly related to your live demo, follow-up communications, pricing information, and scheduling.

Opt-out: You can reply STOP at any time to unsubscribe from SMS messages.
